Default Different take on adverse possession...

I came across this from linked information on that land grab up in Boulder that has been in the news. This doesn't have to do with the Kirlins' case, but another case.

I stuck this in land use because if you open the url you'll see some not so nice "light" shed on off road use has come out of this case . I know nothing about this other than what is on this page but basically the land owners are claiming they have saved the land from off road abuse and that the Jeepers aren't practicing what they preach - Tread Lightly...

Obviously all one sided...I don't know the area at all but I certainly recognized the Jenny Creek name in some of the links on the page...I guess I'm stumped on whether I should be mad and at which party

Old news and nothing to do with adverse possession. Every thing to do with RS 2477.

This was settled months ago and Barking dog will remain closed. One of the things that came out of the proceedings, the courts determined that neither individuals nor the US Gov. can assert rights under RS 2477. Only counties can. If Boulder County doesnt claim a right of way on Barking Dog, then it's not a road.

Don't believe every thing you read posted by Boslough or Brandt, they both have a major case of cranial/rectal inversion.

Wow, I had nearly removed that whole Ballarat / Barking Dog thing from my memory. IF I remember correctly, my OPINION at the time was that neither side was really "right". Unfortunately when you have a guy like V.B. representing your point of view, you're going to lose more than you're going to win. In fact I took the stand in a CO4x4 discussion years ago that maybe the property owners had a point. It does suck when people you don't know and didn't invite drive across your land, spill oil, leave beer cans, toilet paper flowers, etc.... when its your land it doesn't really matter if they have the "legal" right to be there or not, and unfortunately 4x4 enthusiasts have a long history of not respecting the land. I know thats an unpopular sentiment, but I pick up far more trash than I bring EVERY time I go out, that doesn't seem to be getting any better. Anyway I got slapped down pretty hard by the VB supporters, thus endeth my time on CO4x4, I don't have time for that.

If any good comes of this, I hope its that people on our side of the fence remember that motorized recreation types like ourselves are fighting an uphill battle. We have to hold ourselves to a higher standard EVERY time we go out - because it only takes one instance of bad luck / poor choice to turn the tide. Just my opinion.

Its good to hear that support for his kind of rhetoric is lessening. Maybe I'll venture back over there, cuz that's what I need, yet one more forum to distract myself with
